Oregon State University could obtain exclusive license of blueberries 'Baby Blues'

The Agricultural Research Service of the US Department of Agriculture. (ARS-USDA) published a 'Notice of Intension' in the Federal Register with which it seeks to grant the Oregon State University Of Cornallis, Oregon, the exclusive license for the variety of blueberry "Baby Blues".
This variety is described in Plant Patent Application Serial No. 14 / 545,561, “BLUEBERRY PLANT NAMED 'BABY BLUES'”, filed on May 21, 2015.
The notification states that "The patent rights of the Federal Government in this variety of plant are assigned to the United States of America, represented by the Secretary of Agriculture".
He adds that "the prospective exclusive license will be for royalties and will comply with the terms and conditions of the 35. USC 209 and 37 CFR 404.7 ".
"The prospective exclusive license may be granted unless, within thirty (30) days from the date of this notice, the Agricultural Research Service receives written evidence and arguments that the granting of the license would not be consistent with the requirements of 35 USC 209 and 37 CFR 404.7 ", details the document.
The notification is open for comments until the 26 of October of 2015.
