Peru's new plastic law regulation could affect importers

In Peru they are processing the regulation of the Law of Plastics for single use, which they expect to be approved in July.

With the entry into effect of said law a large number of businesses would be affected and so far, is still in doubt if it will impact the Peruvian agro-exports industry.

Jesús Salazar, president of the Plastics Committee of the National Society of Industries (SNI) explained to PortalFrutícola.com, that the 30884 law "only regulates single-use plastic ... what is consumption for food, transportation of food, consumables. "

"But these containers for agricultural exports are not considered, those are beyond the scope of this law," he said.

However, he clarified that perhaps it could have an effect on the sector, on the negotiation of regulation.

"Because there is a last article that says the law, where they mention that the Ministry of the Environment through the regulation that is made to the law could incorporate other plastic products that may cause the same effect as those that are being regulated", Indian.

In Peru, flexible and rigid plastic packaging is the 60% of the national plastic production. Reason for which Salazar considers that the law would have a quite strong impact on the Peruvian plastic industry.

"The production of flexible packaging in Peru is more or less 350 thousand tons per year and the rigid packaging is about 320 thousand tons per year," he said.

He added that "all types of packaging are included here ... but of that, I consider that at least one 30% would be within the scope of the regulation of the law".

Ministry plan

Salazar said that the sector does not coincide with the plan generated by Peru's Ministry of Environment, despite sharing the goal of protecting the environment.

"They have opted for a prohibition on the one hand and on the other hand, the bags that are wanted in the market are increasing their thickness and volume, which means that we are increasing the final problem of exposure of these post-consumer products and the problem is going to be bigger. "

He said that part of the solution for them involves the circular economy, which is not just recycling, although it is an important component.

"We speak for example of the redesign of our products," he said, adding that the plastics industry has to adapt its production models and processes to more eco-friendly materials, to more eco-friendly designs that facilitate recycling.

He stressed that there is also a lot of work to do on the side of consumers, that they know what to do with the product once they finish using it.

Because the law is national, importers and all those companies that bring products to Peru must keep abreast of how the new legislation impacts their products.

"The law was approved in December of last year and the regulations of the law are now coming out in July, we are already in the last steps. I believe that already in July, August we have regulations, "he remarked.
